By using A&I Photographic and Digital services and it’s subsidiaries including A&I Books (“A&I”), you agree as the customer (“the Customer”) to follow and be bound by the following disclaimer (“Agreement”) and you represent and warrant that you are authorized to enter into this Agreement on behalf of yourself and/or the entity that you purport to represent.
Quality
A&I is committed to providing high quality products. It is the responsibility of the Customer placing the final product order to check and approve a PDF proof, whether through the Book Creator software or otherwise, for any errors in design, text, background, border and/or any other layout effect including but not limited to the effects offered within and/or imported to the Book Creator software.
File Size/Color Management
A&I is not responsible for any file submitted that is too small or any files that are not properly color corrected and thereby has a print quality that is not appealing to the Customer. A&I Book Creator software will alert you of any files that are too small to print well but will not alert you to any color management issues.
Tests
For Customers ordering more than one book/calendar or ordering a product where layout and color management are extremely important, we highly recommend that the Customer order a test to serve as a printed proof. A test may be ordered at full price (quantity: one) to approve all elements of the product. Any necessary changes to the product must be made by the Customer and resubmitted or must be ordered for A&I Books to fulfill and be paid for by the Customer. If a test print is not ordered, or if a test is ordered and no changes are made, or if problems occur due to a color management or calibration issue, A&I is not responsible for any quality issues as listed above.
A&I Logo Presence
It is company policy for the current A&I Books logo to appear on all products printed in the A&I Books department including but not limited to all products made using the Book Creator software. If the logo is removed, covered or not included by the Customer, the A&I Book department will replace the logo on the printed product. The logo will automatically appear on the last page of the product within Book Creator and is visible to the Customer designing the product within Book Creator.
Shipping
A&I takes great care in packaging products for shipping. All shipments are sent Signature Required for safe delivery unless requested otherwise by the Customer. Should any product(s) be damaged in shipping, A&I is not responsible for reprinting, monetary return or any other method of reimbursement to the Customer. Orders are by default insured in the amount of $100, payable by the courier. Additional insurance may be purchased and must be specified by the Customer and paid in full prior to shipping. If insurance must be collected for a product damaged in shipping, it is the responsibility of the Customer to collect directly from the courier.
General Agreement
A&I is not responsible for any incorrect or inaccurate content within the product and full responsibility is held with the Customer(s) or other organization creating the product including but not limited to the Customer(s) using the A&I Book Creator software. This Agreement announces that you as the Customer hold A&I and each of their directors, partners and employees, harmless from and against any loss, liability, claim or demand, including reasonable attorney’s fees, arising out of any claim, action, investigation or proceeding made or instituted by any third party due to or arising out of your use of A&I Books including but not limited to the A&I Book Creator software in violation of this Agreement or your violation of any law or the rights of a third party. A&I reserves the right not to print any material which may be considered offensive or inappropriate.
Copyright Agreement
This is to certify that A&I has been authorized by the Customer to manufacture their product. (If the Customer is not the copyright owner, this certifies that the Customer has the licensing rights for this material and authorizes A&I to manufacture the product on their behalf.) In the event any person, entity or agency contests, disputes or challenges A&I regarding the replication/duplication of any content of the product, the Customer agrees to indemnify A&I, and hold harmless from all legal expenses that may be incurred by A&I, as well as all damages infringement of any patent, copyright, trademark, trade dress or trade secrets. A&I agrees this Certification and Indemnification shall continue for a period of ten (10) years from the date this Copyright Certification and/or Licensing Rights and Indemnification was agreed to. In consideration of A&I undertaking to perform services for the Customer, the Customer agrees to be bound by the terms of this Copyright Certification and Licensing Rights and Indemnification. |
